Problems that clients face with this type of injury and what the law says.
The most common injuries to the skin are abrasions and lacerations. An abrasion is simply where the surface of the skin has been rubbed off. This is usually thought of as a graze. A laceration is a cut or wound to the skin.
Most awards for injuries to the skin are calculated by reference to the scarring or disfigurement caused by the injury. Generally scarring (especially on the face) on a female carries a higher compensation award than on a male.
Any scar, however small, can be embarrassing to the individual concerned. The courts take into consideration the cosmetic affect of scarring in reaching an award. A single scar which can easily be hidden by clothing will receive a lower award of compensation than a scar which will constantly be on display.
